Pursuant to the Vermont public records law (1 V.S.A. §§ 315-320), I hereby request the following records:
I am looking for the following:
1. Accounting figures related to budgeting and any severance paid to former town employees from FY2005 to current, this information can be de-identified.
2. The most recent expense reports, for the past twelve months, for members of the Northfield Selectboard (John Quinn III, Matthew Gadbois, K. David Maxwell, Kenneth Goslant, Lynn Doney) and the town manager Jeff Schulz.
3. A full copy of all contracts and written agreements made by the Town of Northfield for 2014 and 2015.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Dziobek,
In regards to Item 1, please be more specific? What do you mean by severance paid?
Items 2. The Select Board does not have an expense account. Prior to this year, the Board members each received a $600 a year stipend. However, with the current budget that ends June 30, 2016, the Board voted not receive a stipend. Therefore, they did not receive any stipend during the past 12 months. If Board members wish to attend a conference related to Town government, the Town will pay for it. The manager does not have an expense account. The manager can be reimbursed for conferences and workshops and mileage.
Item 3. This will take some time and expensive. Is there a specific document you are looking for?

In regards to item 1, I am referring to any payouts to former employees following the end of their employment. This could include an ongoing severance payment and/or other payment arrangement following the separation of an employee from the town.
For Item 2, I would like a copy of the reimbursement forms (as expense reports are not applicable) for those individuals listed for board members, and conference, workshop, and mileage reimbursement for the town manager.
For Item 3, may I request a quote on the cost of these documents?

Dear Mr. Dziobek,
In regards to item 1, I am still researching this item and am getting a legal opinion on what is protected and checking whether we can charge for attorneys time.
In regards to item 2, attached is list of expenses. Also you will see, the Select Board received their stipend in June, 2015. I had originally thought that the stipend was given in December of 2014.
We have about $87.00 in costs thus for all three items. I anticipate that there will be another $330 in costs (estimate) as there are numerous contracts and significant research time.

The costs are based upon staff time and research time. In regards to item one, I and my staff will have to research personnel files, talk to past managers and Select Board members to determine what severance packages, if any, were given out.
In regards to item 3, there many contracts and agreements and this will take significant research time.

I would like to remind you of the law in Vermont.
Agencies may only charge fees for public records that are established by law. Absent
any particular statutory fee, public agencies must establish fees based on what is
allowed by 1 V.S.A. § 316.
Agencies may only charge and collect from the public the actual cost of providing the
copy, including costs associated with the mailing or transmission of the record. Staff time
for complying with a public record request may not be charged or collected unless the
following conditions have been met:
Staff time directly involved in complying with the request exceeds 30 minutes;
The agency agrees to create a new record; or
The agency agrees to provide the record in a non-standard format and the staff time
directly involved in complying with the request exceeds 30 minutes.
Upon request, an agency must provide an estimate of the charge. In addition, the
agency may request that any requests subject to staff time charges be made in writing
and that all charges, whole or in part, be paid prior to the delivery of copies. Receipts
must be provided to the public.
The local legislative body of any political subdivision must establish actual cost charges
for copies of public records, including costs for staff time. In both cases, the local
legislative body must hold a public hearing prior to adopting a uniform schedule of public
record charges and the schedule may only be based on the factors outlined in 1 V.S.A. §
316(d). A schedule of public record charges must be prominently displayed in town
offices
If the local legislative body of any political subdivision fails to adopt a uniform schedule
of public record charges, the Uniform Schedule of Public Records Charges for State
Agencies must be applied until the local legislative body establishes a schedule of its
own.
Will your town be working from your own set fee (and if so, I would like to know the fee schedule) or will you be using the VT Uniform Fee Schedule for Public Record Requests?

* Senior-level and IT specialists’ time doing research: 57 cents/minute
* Regular staff time doing research: 45 cents/minute
* Staff time spent making copies, beyond the first 30 minutes: 33 cents/minute
* Copies (single sided): 5 cents/page (unless Northfield has established a different fee for copies)
* Copies (double sided): 9 cents/page (unless Northfield has established a different fee for copies)
* Color copies: $1/page (single sided)

Apologies for being so direct, but I understand what statute can charge. This request is now almost three weeks overdue from at least an acknowledgement that you are working on the request. Please answer the following for me in addition to providing YOUR (Northfield) fee schedule and the breakdown of how you are calculating these costs. An example of this would be Senior-level IT needs X amount of minutes to complete this request at the rate of 57 cents/minute. .
Can you please answer me directly related to the following as I need to know if these are denials and to take next steps to get said documents.

Attached is a copy of the conflict of interest policy. I am not aware of any conflict forms. Attached is the email with the original request and the information we sent to you. You did not mention that anything was missing.
I provided you will a portion of the information in the second request and thus have been working on it. I gave you an estimated cost for the other information. You responsed to the emails. Our Attorney stated that we can charge for research and special request information.

The last I had heard from Ken was that you were working on this and subsequent emails were NOT answered by anybody from your offices.
So to confirm, are you or are you not working on researching and subsequently releasing Items 1 and Items 3 of my request?
As I said in the prior message, you have not provided the Northfield fee schedule only: "Copies (single sided): 5 cents/page (unless Northfield has established a different fee for copies)" If the Town of Northfield is charging differently than the State, per the statute you must have a set fee schedule that was approved. If this is the case, please provide me with it.

Jeff,
I am interested in the documents, hence the effort I have put forth over the past month. I am concerned however that your lack of answering my direct questions will lead to production of the wrong records. Can you please provide me with the estimated staff time using the Vermont Fee Schedule for Public Records Requests?
I spoke with town managers in other towns in Vermont and my request by their estimate would take no more than an hour. Please provide me with an ACCURATE estimate of how the fee schedule will be applied to this request, as I asked several days ago. You provided me with a figure that does not appear to follow the Fee Schedule, so your calculations would be appreciated.
I do not want my request to turn into a blank check for you to create records which should have existed already. I am confused as to why severance figures related to budgets need significant amounts of research (your words), the same confusion can be said for current contracts and agreements. Can you please explain to me why the town does not have this on hand?

1. Accounting figures related to budgeting and any severance paid to former town employees from FY2005 to current, this information can be de-identified.
2. The most recent expense reports, for the past twelve months, for members of the Northfield Selectboard (John Quinn III, Matthew Gadbois, K. David Maxwell, Kenneth Goslant, Lynn Doney) and the town manager Jeff Schulz.
3. A full copy of all contracts and written agreements made by the Town of Northfield for 2014 and 2015.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
