Pursuant to North Dakota Constitution, Article XI, Section 6, and the North Dakota Open Records Statute, N.D.C.C. § 44-04-18(1), I hereby request the following records:
A log of public records requests submitted to the Department of Human Services that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.
The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am in receipt of your request and expect to provide a response early next week. I apologize for the delay. The request was forwarded to me while I was out of the office and I have been able to begin work on it just today. We are in the process of reviewing the document we have to ensure there is no confidential information in it.
Please note, the document the Department has does not contain the information you requested prior to mid-2009. Pursuant to N.D.C.C. section 44-04-18(4), a public entity is not required to create or compile a record that does not exist. Accordingly, we will provide you with the information we have from mid-2009 to the present that is responsive to your request.

Attached is a file that includes the information you have requested. We have redacted confidential client information. Additionally, N.D.C.C. section 44-04-18.21 provides that “electronic mail address or telephone number … provided to a public entity … for the purpose of or in the course of communicating with that public entity is an exempt record.” Accordingly, we have redacted any e-mail addresses or phone numbers that were in the Open Records Request Log as well.
