Attention: Work Opportunity Tax Credit (WOTC) Unit

To Whom It May Concern:

Pursuant to the North Carolina Public Records Law, I hereby request the following records:

1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database tracking Work Opportunity Tax Credit certifications which is created or maintained by your department or by any third party vendor under contract with your department, preferably in .csv or .xlsx format. If it is easier, the database can be limited to the calendar or fiscal years ending in 2018, 2019 and 2020.
3) The most recent of any contracts with third party vendors to track WOTC certifications.

My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good morning Ms. Corwin - please find attached the responsive records based on point 1 of your records request.

With respect to your point 2 question, the U.S. Department of Labor advises us to direct data inquiries to the WOTC Performance webpage<https://www.dol.gov/agencies/eta/wotc/performance> on the federal DOL/ETA website.

With respect to your point 3 question, our agency does not use 3rd party vendors for WOTC, except through the Government to Government Service. Our Division of Workforce Solutions does not hold any of the contracts.

Unless you have particular questions, this will conclude this particular public records search project.

Hi David,

Thank you for these records, I appreciate it.

Regarding item #2, thank you for directing me to the federal reports. I am familiar with them. Unfortunately, they do not contain the level of detail I am seeking. As I mentioned in my request, I am seeking the database NC uses to create the reports it sends to US DOL. In particular, I am seeking records from the database covering years 2018, 2019 and 2020. In response to this request, many states have been able to provide me with the following fields for all WOTC applications during those years:

Business name | Employee target group | Starting wage | Job position | Date | Approved/Denied

I am happy to chat with you or a data/ IT employee if that would be helpful. I will also attach an example for your perusal, and can send addition examples if you require.

If this request is to be denied, I ask that you cite the relevant statutes exempting these records from disclosure.
