To Whom It May Concern:
Pursuant to North Carolina Public Records Law (G.S. §§ 132-1 through 132-10), I hereby request the following documents:
Training plans submitted by North Carolina Police Departments and Emergency Services Units to the Department of Defense's NC state coordinator, Mr. Michael Tart, for the use of 1033 equipment and vehicles - as described in the below statement from Michelle McCaskill, spokesperson for the Defense Logistics Agency:
"It has always been the responsibility of each state’s designated coordinator to ensure that each and every Law Enforcement Agency (LEA) is trained on the equipment they received from the 1033 program. LEAs are required to certify to DoD through the state coordinator they have a training plan for an asset that requires specialized training, to include armored vehicles and aircraft, before the equipment is issued. LESO receives a copy of the plan only – the approval process is at the state coordinator level."
If any supplementary training material was included with the proposal (e.g. a powerpoint such as this: https://s3.amazonaws.com/s3.documentcloud.org/documents/2162544/responsive-documents.pdf), please consider this within the parameters of the request. With each training plan submitted by an Emergency Services Unit, please also provide any documents that list the participating police agencies and/or which departments house the vehicles and equipment that require training.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.
Sincerely,
Daniel Welch

Mr. Welch:
The Law Enforcement Services Section will be able to compile the requested documents as noted in your e-mail. However, it is estimated it will take a total of eight to ten hours of staff time to compile.
By NC statute, an agency may charge a special service charge for any request that requires extensive use of information technology or extensive clerical or supervisory assistance by personnel of the agency. If a request takes more than four (4) hours of clerical or supervisory assistance to fill, the agency may assess a special service charge for the amount of staff time spent over four (4) hours. Staff time spent searching for, locating, collecting, sorting, copying and preparing the records to be produced will count towards the four (4) hour threshold. The special service charge shall be in addition to any copying fees.
The special service charge for clerical or supervisory assistance results in a rate of $18 per hour for an estimated total of $144 to $180. In order to start the process your request, DPS will need at least half of the estimated cost in advance. We will go with the lower of the two estimates and make any adjustments to the final installment if it turns out to be an amount lower or greater than what is quoted. If you wish for DPS to move forward with your request, please send a check for $77 made out to the Department of Public Safety to the below address.
If you prefer to narrow your request to try and come under the four hour threshold, thus avoiding the special service charge for staff time, please let us know and we will try to assist you with a modified request.
Sincerely,
Pamela Walker
