Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:
There appears to be a lack of transparency and/or understanding regarding certain members of the Niles-Maine Library Board Trustees. We request open and transparent information respecting the public business of this public body. Communications pertaining to the transaction of public business are public records, even on personal accounts.*
Please provide copies of all records of all correspondence in Niles-Maine District Library Board Trustee Suzanne Schoenfeldt’s possession regarding library business in systems not maintained by the Niles-Maine District Library.
This includes but not limited to, text messages (iMessage, SMS messages, Signal message, What’s App, or any other similar messaging services & social media accounts), phone numbers, emails (to, from, cc, bcc, including any attachments), or phone notes. Requesting responsive documents for dates between May 19, 2021 and the date this request is processed (inclusive of those dates).

“Illinois FOIA exists to protect the public's right to know what its government is up to. Giving public officials like police officers carte blanche to evade FOIA laws by using personal email for public purposes would eviscerate Illinois FOIA. Moreover, public officials would have an incentive to avoid FOIA by deliberately communicating about sensitive or controversial topics on private email. This flies in the face of the very purpose of public information laws.”
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Response: The Niles-Maine District Library has no public records responsive to your request.
If your request for public records has been denied in full or in part, you have a right to have the denial of your request reviewed by the Public Access Counselor (PAC) at the Office of the Illinois Attorney General. 5 ILCS 140/9.5(a). Hello,
On May 17th Assistant Attorney General of the Public Access Bureau, Teresa Lim, delivered a determination through their PAC review that the responses by the Niles-Maine District Library regarding this FOIA request violated FOIA. This letter has been delivered to Mr. Gregory J. Pritz as well as Mallory Miluzzi of Klein, Thorpe, & Jenkins.
In that determination the Attorney General requests:
“This office requests that the Library ask the trustees to perform additional searches of their personal accounts and devices for any responsive communications pertaining to Library business within the specified time period. The Library should disclose copies of any responsive records to ███████, subject to any permissible redactions.”
Please conduct additional searches and provide the resulting responsive records in accordance to the Illinois Freedom of Information Act.
