Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:
1. the total number of use of force incidents, separated by type of force and year used in 2020 and 2021 (for example, information that specifies the number of taser incidents in 2020, the number of taser incidents in 2021, baton incidents in 2020, baton incidents in 2021, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained in 2020 and 2021.
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained in 2020 and 2021.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained in 2020 and 2021.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained in 2020 and 2021.
6. the total number of officer involved shootings in 2020 and 2021, both fatal and non-fatal.
When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.
Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Morning;
The Office of the Clerk of the City of Newark has assigned your request tracking number PD-22-0482 and forwarded it to the Police Division.
On March 20, 2020, Governor Murphy signed into law P.L. 2020, c.10, which provides that OPRA’s statutory deadlines do not apply for the duration of a Governor-declared state of emergency pursuant to the Disaster Control Act (N.J.S.A. App.A.9-33 et seq.), a public health emergency under the Emergency Health Powers Act (N.J.S.A. 26:13-1 et seq.), or when a state of local disaster emergency is declared by a county or by a municipality. On March 4, 2022, Governor Murphy reinstated New Jersey's State of Emergency created pursuant to Executive Order 103 with Executive Order No. 292.
In order to gather the documents responsive to your requests, the OPRA unit sends your requests to the respective City Departments, which actually created, received, or retained these documents. Since the State of Emergency, crucial City Staff have retired, become sick, and work a staggered schedule, which makes the time needed to gather responsive documents far longer than usual.
Also, it may be that there are only DVD copies of the UFRs. Therefore, please provide an address to which DVDs can be mailed.
This Office received your request on April 4, 2022, and anticipates a police response by May 9, 2022.
