All sex-education materials maintained by the department, as well as guidance / instructional memos for how teachers are to teach the materials.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Skelding:
This letter concerns your Freedom of Information Law (FOIL) request. Please be advised that pursuant to Section VI.C of New York City Department of Education (“DOE”) Chancellor’s Regulation D-110 (“CR D-110”), additional time is needed to respond to your request. Factors to be considered under CR D-110 in determining whether there exist circumstances necessitating more time to respond to a request may include, but are not limited to, “[1] the volume of a request, [2] the ease or difficulty in locating, retrieving or generating records, [3] the complexity of the request, [4] the need to review records to determine the extent to which they must be disclosed, and [5] the number of requests received by the agency.”1
With respect to factor 2, your request requires searching multiple DOE offices. With respect to factor 4, responsive records will undergo review to ensure any records or portions thereof are exempt from disclosure. With respect to factor 5, at the time you made your request several other FOIL requests were already pending, many of which involved multiple factors or all of the factors cited above.
Please note that the list of factors is not exhaustive, and that additional extenuating circumstances apply here. Currently, additional time is also needed to process your request because offices tasked with locating, retrieving and reviewing responsive records are prioritizing matters relating to COVID-19 and are therefore experiencing increased workloads.
Given the circumstances applicable to your request, a response is expected by February 28, 2022.
