Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The following documents regarding FOIL # F2013-20, received by the New York City Council on 2/20/2013 and submitted by Eric Ohlsen, which requested "All letters or public communications from former CM de Blasio referencing Maimonides Medical Center and his wife Chirlane McCray."

Documents requested include:

-- Correspondence between Eric Ohlsen and the NYCC FOIL officers
-- Processing notes and internal communications for the request
-- Documents released per the request

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Skelding:

This letter serves as a response to your Freedom of Information Law request, received in this office on the above date related to a FOIL request received by the New York City Council on February 20, 2013 from Eric Ohlsen. You have requested: 1. Correspondence between Eric Ohlsen and the NYCC 2. Processing notes related to this request 3. Documents released as per this request. I have attached all responsive documents to your request and there are no further responsive documents to this request.

Please be advised that part two of your request which asks for all processing notes and internal communications related to this request is denied. Pursuant to Section 87 (2) (g) of the Freedom of Information Law which exempts from disclosure inter-agency or intra-agency records that are not (i) statistical or factual tabulations or data, (ii) instructions to the staff that affect the public , (iii) final agency policy or determinations, (iv) external audits, including but not limited to audits performed by the comptroller and the federal government. Examples of communications withheld are inter-agency or intra-agency communications that were expression of opinion, advice or non-final agency deliberations. Additionally, pursuant to §87 (2)(a)of the Public Officer's Law portions of these documents specifically exempted from disclosure by state or federal statute may be withheld. Certain communications withheld represent communications between Council staff and Council attorneys for the purpose of receiving or rendering legal advice and accordingly are subject to the attorney-client privilege (see CPLR §4503 (a) and/or constitute privileged attorney work product (See CPLR §3101 (c)).
