Pursuant to the New York Freedom of Information Law, I hereby request the following records:

All personnel records and investigative records where the identified subject is either Louis Eppolito or Stephen Caracappa, retired NYPD detectives. "Personnel records," as defined by the law, are those records used to evaluate performance toward continued employment, promotion or discipline internal to the Department. "Investigative records" should include any record routinely used in a criminal prosecution.

Both Eppolito and Caracappa are both widely reported as deceased; a report of Eppolito's death in 2019 (that also notes Caracappa predeceasing him in 2017) is attached as proof. As such, there are is no longer any privacy interest served in the withholding or redaction of either personnel or investigative records.

To assist in identifying records, the following is known of Eppolito:

First 5 Digits of SSN: 129-36
Date of Birth: 7/22/48
Date of Death: 11/03/2019
NYPD Dates of service: 8/1/1969 through 2/18/1990

To assist in identifying records, the following is known of Caracappa:

First 5 Digits of SSN: 115-32
Date of Birth: 11/12/41
Date of Death: 04/08/2017
NYPD Dates of Service: 6/30/1969 through 11/4/1992

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I appeal this rejection on the grounds that it is baseless.

The request specified two persons (Stephen Carcappa and Louis Eppolito), and two classes of documents (personnel records and criminal records) for each person.

Adequate descriptions of the two individuals named (including names, dates of birth, social security numbers and service dates) were provided so that a search for records could be performed through a standard electronic lookup.
