Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

Copies of NYPD Intelligence Reports generate in conjunction with investigations of Muslim Student Associations (MSAs) between 2006 and 2009. Please also include copies of any "Weekly MSA Report(s)" generated in this time frame.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Jonathan,

I’m appealing the rejection of my request (original request below, rejection enclosed), which was rejected under 87(2)(f), 87(2)(e)(iii), 87 (2)(e)(iv) and 87(2)(e)(i).

While certain portions of my request might be rejected under these exemptions, it is unreasonable to not provide segregable portions of the requested documents that do not fall under one or more of these specific exemptions, and to cite these specific exemptions specifically for the redacted portions of the released documents.

At the very least, releasing cover letters, page totals, and other meta data, for example, would endanger no lives, reveal no confidential information and would not interfere with an ongoing investigation.

In addition, while it is difficult to appeal such a vague rejection without any material released, it is reasonable to assume that some material, with names redacted, not endanger life and would detail routine investigative techniques, thus not falling under the exemptions cited.
