Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
Memorandums of Understanding, "user agreements," or any other documents detailing how the New York City Police Department accesses the ATF eTrace system, retain data provided in response, or otherwise initiate firearm trace requests.
Please indicate if the NYPD does not have a memorandum of understanding and/or user agreement with ATF regarding use of eTrace, and if so, how long they have lacked such an agreement. If NYPD does not have a memorandum of understanding and/or user agreement, please indicate how or if NYPD is able to requests firearms traces from ATF.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
