Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

* A copy of any data sharing agreements as well as data sharing policies in place regarding information collected and stored for the city's municipal ID program.
* A copy of any data retention policies in place for information collected and stored for the city's municipal ID program.
* A copy of the five most recent requests from federal agencies received by the city for information held within a database associated with the city's municipal ID program.
* A copy of the most recent policy, presentation, or plan (whichever is most readily accessible) regarding responding to bulk data requests for information on non-U.S. citizens from a federal agency.
* A copy of any logs or other summary reports detailing unauthorized usage of databases associated with the city's municipal ID program.

If this request is unduly burdensome, I am happy to discuss suggestions for reducing the scope of it.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Michael Morisy:

This letter responds to your Freedom of Information Law (FOIL) request made on September 7, 2017, in which you requested the following:

1. A copy of any data sharing agreements as well as data sharing policies in place regarding information collected and stored for the city's municipal ID program.

2. A copy of any data retention policies in place for information collected and stored for the city's municipal ID program.

3. A copy of the five most recent requests from federal agencies received by the city for information held within a database associated with the city's municipal ID program.

4. A copy of the most recent policy, presentation, or plan (whichever is most readily accessible) regarding responding to bulk data requests for information on non-U.S. citizens from a federal agency.

5. A copy of any logs or other summary reports detailing unauthorized usage of databases associated with the city's municipal ID program.

The Department of Social Services/ Department of Homeless Services OR Human Resources Administration ("DSS/DHS or HRA") is hereby granting your request in part and denying in part. Attached are records responsive to Point 1 above. The agency currently has four (4) agreements, all of which are included.

In response to point 2 above, a copy of the agency's data retention policy is available online at https://www1.nyc.gov/assets/idnyc/downloads/pdf/eo_739_retention_120716.pdf

In response to Points 4 and 5 above, please be advised that after a diligent search, no responsive records could be located.

Lastly, all records responsive to Point 3 above are hereby denied pursuant to Public Officers Law Sec. 87(2)(e)(i), as release of such requests will interfere with law enforcement investigations and judicial proceedings.
