To Whom It May Concern:

Pursuant to the New York Freedom of Information Law, I hereby request the following records:

All records of communications (including letters, email and memoranda) that memorialize discussions with staff of the Comptroller of New York City, staff of the New York City Police Department, and/or any unit of the Department of Justice (e.g., FBI, DEA, US Attorney's Office) pertaining to the "Mob Cops" case.

The following lists of names of persons and institutions are provided, where a search for the name may provide relevant records:

The Mob Cops: Stephen Caracappa, aka "Steve Caracappa"; Louis Eppolito, aka "Lou Eppolito"; NYPD Major Case Squad - Organized Crime Homicide Unit (aka "OCHU"); and 62nd Precinct.

Homicide victims: James Hydell, aka "Jimmy Hydell"; Nicholas Guido, aka "Nicky Guido"; John Heidel, aka "Otto Heidel"; Anthony DiLapi, aka "Tony DiLapi"; Bruno Facciolo; Edward Lino, aka "Ed Lino"; Bartholomew Boriello, aka "Bobby Boriello."

Victim of False Testimony: Barry Gibb.

All natural persons named above are known to be deceased, and there are no privacy concerns (including those under Civil Rights Law 50-a or under exemptions to the Freedom of Information Law) that prevent the release of records. Please find attached proofs of the deaths of individual persons: a Daily News article attesting to the death of Louis Eppolito in 2019 and death of Stephen Caracappa in 2017; a DEA press release from the time of the arrest of Caracappa and Eppolito that discusses their victims is attached as proof of their deaths; and finally, a profile from the Innocence Project, Barry Gibb's representative, notes his death in 2018.

Please note as well that the NYPD Major Case Squad's Organized Crime Homicide Unit (OCHU) no longer exists.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

T. McElwee
