Hello,
I submitted this request on May 12, 2021. I last heard from you when I got a generic acknowledgement on May 21, 2021. That acknowledgement promised a response within 20 business days. As of close of business today, 92 business days have passed. I am aware that Covid and the resultant staff shortages and restrictions have complicated matters, and I have made allowances for that. However, at this point, more than three months have passed since DHMH took any action on my request, which puts your agency out of compliance with New York state law. This request requires nothing more than retrieving and scanning a personnel file, and minimal redaction. It is not a complex or labor-intensive request, and I have not been provided with any explanation of why it is apparently not being processed.
Please contact me as soon as possible with an estimate of when I can expect to receive the responsive documents.

Thank you for your prompt response to my emails on Friday. I'm surprised to hear you have no records of Kolodny's employment there, as it was well publicized. I haven't been able to locate DHMH's retention schedule. Does the department purge employment records after a certain amount of time?

DOHMH was able to locate the attached after receiving your last inquiry on this matter. Information that would constitute an unwarranted invasion of personal privacy has been redacted pursuant to FOIL §§ 87(2)(b) and 89(2)(b).

We suspect that any additional records which may have been responsive to this request were destroyed during Hurricane Sandy.
