Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The five most recently submitted investigative data reports. According to the March 1999 quartermaster's list of printed forms, this report is PD 342-150.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Mr. David:

I am writing to appeal the rejection of request 2013-PL-8082, in which I requested on October 30, 2013 copies of the five most recently submitted investigative data reports.

Lt. Mantellino indicates in the attached letter that he is "unable to locate" responsive documents. I appeal the adequacy of the FOIL Unit's search, particularly since my request included the particular form number that NYPD uses to refer to these reports (PD 342-150). I have also attached a page from the list that Lt. Mantellino himself sent me in December that notes the name and number of these reports.

It is unacceptable that these responses continue to come from the FOIL Unit, particularly when my requests are as targeted as possible. Please direct the FOIL Unit to conduct another search for the documents that I've requested.

In your appeal determination for 2013-PL-8082, you indicated that the requested form, PD 342-150, "are no longer used by NYPD." Having attempted to contact you by phone without success, I now request reconsideration of your determination on two grounds.

First, my request is not for a current copy of the report, but for the five most recently submitted. Even if the forms are no longer in use, that they were previously used suggests that my request can be completed as submitted.

Second, the NYPD FOIL Unit released to me a subject matter listing (attached) in December 2013 (request 2013-PL-8085) that contains PD 342-150 (p. 7). Given how recently I obtained this listing, I see three possibilities:
(1) Form PD 342-150 is still in use;
(2) NYPD did not release the current subject matter listing to me in 2013-PL-8085 as requested, in which case I would need to submit this request a third time; or
(3) NYPD has ceased using form PD 342-150 since December 3, 2013, in which case I would refer you back to the paragraph above.

Please advise at your earliest convenience.
