Pursuant to Port Authority's FOI code, I hereby request:

- Specific safety inspection, engineering or other reports and/or memos about the structural integrity, longevity and ongoing usability of the current Hudson River tunnel that Port Authority oversees for commuter rail service. This includes any reports by Port Authority officials themselves, or any reports that the Port Authority is in possession of from from other agencies or consultants.

I hereby request such reports and/or memos from 1/1/2016 to the present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. IBT/Newsweek is an award-winning journalism outlet and these documents are of significant public importance.

In the event that some records are exempt or redacted, we request that other records that are not exempt or redacted be released. If it is your position that some or all records are exempt from the open records law, IBT/Newsweek requests that you immediately forward a privilege log/Vaughn Index setting forth each withheld document with sufficient information “respecting the basis of the privilege-confidentiality-exception claim vis a vis each document.” Id. (quoting Hartz Mountain Indus., Inc. v. N.J. Sports & Exposition Auth., 369 N.J. Super. 175, 185 (App. Div.), certif. denied, 182 N.J. 147 (2004)). See also Newark Morning Ledger Co. v. New Jersey Sports & Exposition Auth., 423 N.J. Super. 140, 162 (App. Div. 2011) (“OPRA generally places the burden upon the custodian of a public record to state the ‘specific basis' for the denial of access…In so doing, the reasons for withholding documents must be specific.”).

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a follow up to a correspondence sent by the Port Authority to me on 4/13/17. The Port Authority asked for clarification on my original request (which is attached). The Port Authority specifically asked me to "please specify if your request relates to records for the entire system, or a specific tunnel within this system." My request relates to records for all tunnels in the system (and in the Port Authority's jurisdiction) that go under the Hudson River.
