Subject: Appeal for FOIL Request No. FOIL-2023-002-00206

Dear FOIL Appeals Officer,

I am writing to appeal the handling of my Freedom of Information Law (FOIL) request (FOIL-2023-002-00206), which I submitted to the Office of the Mayor on March 19, 2023. My request sought records related to the involvement of the agency with the Government Alliance on Race and Equity (GARE), Race Forward, and the Center for Social Inclusion.

The Mayor's Office has extended the time to respond to my request twice, each time citing the volume of requests received as the reason for the delay. While I understand that a high volume of requests can pose challenges, the continual extensions without any substantive update or partial fulfillment of the request appear to be a rolling denial of access to the requested records.

The FOIL statute, Public Officers Law Article 6, requires agencies to grant or deny access to records within twenty business days of the receipt of a request. If an agency needs more than twenty business days to locate and assemble the requested records, it must provide a written explanation and a date certain by which it will respond. Continual extensions without a clear end date or without demonstrating diligent efforts to complete the request undermine the purpose of the FOIL and impede the public's right to access information.

I kindly request that you review the handling of my request and take appropriate measures to expedite the processing and fulfillment of my request. If the volume of potentially responsive records is indeed large, I am open to receiving the records on a rolling basis.

Thank you for your attention to this matter. I look forward to your prompt response.
