Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

All emails possessed by CUNY's University Central Office that meet the following conditions:

1. Sent to or from email addresses of the domain @cityhall.nyc.gov.
2. Sent from January 1, 2014 through the date when this request is processed, inclusive.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Thank you for your email dated Sept. 26, 2014 regarding documents you are
seeking
under the Freedom of Information Law (FOIL).
In your letter you requested:

Copies of all e mails possessed by Central Office that were sent to or
from domain @cityhall.gov, since Jan. 1 2014.


Upon receipt of your letter I forwarded it to the appropriate University
office for their review.
We will endeavor to locate any of the requested and covered documents that
may be at Central Office by Oct. 17, 2014.
If we have the records prior to that date, we will forward them to you.
Please give me a call on or around Oct. 17 2014 so we can set up an
appointment for you to review those requested documents that are covered
under the statute. Under FOIL you can review all covered documents free of
charge and may have copies made for .25 per page. If you wish for the
records to be made into electronic documents as stated in your note, that
will add some additional time to the job, depending on the volume of
material and the cost will be based upon:

i. an amount equal to the hourly salary attributed to the lowest paid
agency employee who has the necessary
skill required to prepare a copy of the requested record;
ii. the actual cost of the storage devices or media provided to the person
making the request in complying with
such request;
iii. the actual cost to the agency of engaging an outside professional
service to prepare a copy of a record, but
only when an agency`s information technology equipment is inadequate to
prepare a copy, if such service is used to prepare the copy; and
iv. preparing a copy shall not include search time or administrative
costs, and no fee shall be charged unless at least two hours of agency
employee time is needed to prepare a copy of the record requested. A
person requesting a record shall be informed of the estimated cost of
preparing a copy of the record if more than two hours of an agency
employee`s time is needed, or if an outside professional service would be
retained to prepare a copy of the record.

Please let me know if you wish to proceed under the rules quoted above.


If you disagree with any rulings I may make you can appeal them to the
General Counsel and Sr. Vice Chancellor for Legal Affairs, Mr. Frederick
Schaffer, at the Central Office.

We received your FOIL Request below and have compiled the responsive emails for your review. I am contacting you to schedule a time for you to review those emails on a computer in our office at 395 Hudson St. (corner of Houston St.), 6th floor, NY, NY 10014. We can provide you an office and computer as early as next Tuesday, October 14th.

You will be able to view the emails without charge. The cost for copying any emails is $0.25 per page. Our FOIL officer Dave Fields will need to review any copies you make for exemption purposes. After that, he will then send you all copies, less those that are exempt from disclosure. You can make payment after his review so that you only pay for those emails you receive.
