Additionally, any and all records of disciplinary actions taken against any New York City Marshals or their employees since January 1, 2014.

Additionally, any and all records of enforcement actions filed against any New York City Marshals or their employees since January 1, 2014.

Additionally, any and all records of investigative memoranda naming any New York City Marshals or their employees since January 1, 2014.

Additionally, any and all records of “unusual incident” reports, memoranda, investigations, or notes, as defined by Section 1-10 of the NYC Marshal’s handbook, including but not limited to arrests, assaults, physical injuries, and/or the discovery of contraband, filed by any New York City Marshals, New York City marshal employees, or by DOI employees, pertaining to New York CIty Marshals, since January 1, 2014.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Dear Mr. Frank: This is in response to your Freedom of Information Law (FOIL) request dated 6/9/2019. This is a partial response and an extension of your request. To make it easier, I have broken down your request into five items and responded to each. Please forgive the formatting--the OpenRecords platform is still in early-development and is comparatively primitive and reduces my message to a single block of text.

1. All available records of complaints submitted to the Department of Investigation, and all available records of actions related to those complaints from January 1, 2014, to the date this request is filed naming any New York City Marshals or their employees. Response: This record was provided on 7/19/2019. Please be advised that individual complaints are not provided because disclosure would constitute an unwarranted invasion of personal privacy. See Public Officers Law §§ 87(2)(b) and 89(2)(b).

2. Additionally, any and all records of disciplinary actions taken against any New York City Marshals or their employees since January 1, 2014. Response: This record was provided on 7/19/2019. Please note that this record should also satisfy Item 3.

3. Additionally, any and all records of enforcement actions filed against any New York City Marshals or their employees since January 1, 2014. Response: This record was provided on 7/19/2019 (same record as that provided for Item 2).

4. Additionally, any and all records of investigative memoranda naming any New York City Marshals or their employees since January 1, 2014. Response: Please be advised that a search has located approximately 218 responsive records. By our estimation, it will take approximately 109 hours to collect, review, and redact the investigative memoranda— providing approximately 30 minutes to retrieve, scan, redact, and review each record.

5. Additionally, any and all records of “unusual incident” reports, memoranda, investigations, or notes, as defined by Section 1-10 of the NYC Marshal’s handbook, including but not limited to arrests, assaults, physical injuries, and/or the discovery of contraband, filed by any New York City Marshals, New York City marshal employees, or by DOI employees, pertaining to New York CIty Marshals, since January 1, 2014. Response: Please be advised that a search has located approximately 791 records. By our estimation, it will take approximately 105 hours to review and redact the incident reports—providing for approximately 8 minutes to review and redact each record.

Given the significant time required to comply with the remainder of your request, it would be beneficial if we could discuss your request and determine if, given these initial productions, whether the scope of your request can be refined.
