To Whom It May Concern:

Pursuant to the New York Freedom of Information Law, I hereby request the following records:

A rate cap on third-party delivery platforms such as Grubhub and UberEats took effect on June 2, 2020. The fees may not exceed 5% for the transaction (inclusive of listing, marketing, credit card fees, etc) of an order, and an additional 15% if the third-party does the actual delivery. Restaurants that believe they have identified a violation of the new law were directed to email Foodservicetips@ose.nyc.gov (see https://thenycalliance.org/information/delivery-cap-information-check-your-bills).

I'm requesting a copy of the emails sent to that email address between 6/2/2020 and present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Adrianne Jeffries
