Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

Any and all documents mentioning officer Daniel Pantaleo.

Please consider this to be two separate requests, one request for all documents before July 17, 2014 and a separate request for documents created on or after July 17, 2014. If possible, please prioritize the search for older documents, as the volume of documents after the specified date is likely relatively immense.

For both searches, please reply with any and all relevant documents, memos, files, reports, notes, presentations, statements, audio recordings, multimedia recordings, complaints, legal proceedings, emails and SMS messages.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Re: Freedom of Information Law Appeal

Dear Mr. Mantellino,
I hereby appeal the denial of access regarding my requests, which were made on 12/31/2014 and acknowledged by yourself on 01/21/2015.
The records that were denied include: "Any and all documents mentioning officer Daniel Pantaleo. Please consider this to be two separate requests, one request for all documents before July 17, 2014 and a separate request for documents created on or after July 17, 2014. If possible, please prioritize the search for older documents, as the volume of documents after the specified date is likely relatively immense."
Surely, asking for an officer's personnel records before a certain date is a reasonable request to be made to the Freedom of Information division of a police department. I am not requesting the creation of any new documents.
As required by the Freedom of Information Law, the head or governing body of an agency, or whomever is designated to determine appeals, is required to respond within 10 business days of the receipt of an appeal. If the records are denied on appeal, please explain the reasons for the denial fully in writing as required by law.
In addition, please be advised that the Freedom of Information Law directs that all appeals and the determinations that follow be sent to the Committee on Open Government, Department of State, One Commerce Plaza, 99 Washington Ave., Albany, New York 12231.
