Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

All communications and contracts between DoITT and the following two companies, dated from January 1, 2013 through the date when this request is processed:

1. Titan, an outdoor media company
2. Gimbal, a San Diego company (http://www.prnewswire.com/news-releases/qualcomm-establishes-retail-solutions-subsidiary-as-standalone-company----gimbal-inc-257412701.html)

Records requested include letters, memoranda, emails, any attachments to emails, and other written communications.

Records requested also include any contracts agreed upon between the agency and either company.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I am writing in reference to your request pursuant to the New York Freedom of Information Law (“FOIL”) for copies of all communications and contracts between the Department of Information Technology and Telecommunications (“DoITT”) and Titan and Gimbal, respectively, for the time period January 1, 2013 through the date your FOIL request is processed.

DoITT received your FOIL request on October 6, 2014. Given the very large volume of records that would require individualized review in order to respond to your request, I asked you on November 19, 2014, if you could refine the scope of your request to “specific matters you may be interested in.” You did not respond.

Again on May 21, 2015, I requested that you refine the scope of your request. On June 5, 2015, you responded via email requesting to speak over the phone. I responded the same day with my availability, but did not hear back. I followed up with you on June 18, 2015, requesting to speak with you about your request. As of today, I have not heard back from you regarding this FOIL request.

An initial search for documents potentially responsive to your request produced 6,379 pages of materials. Many of these documents concern routine business with Titan such as e-mails to schedule meetings.

Please respond by August 7, 2015, either narrowing the scope of your FOIL request or forwarding a check in the amount of $1,594 payable to the Department of Information Technology and Telecommunications, to cover the cost of copying the initially identified documents after I have reviewed and redacted them in accordance with applicable law. If I do not hear from you by August 7, I will conclude that you are no longer interested in pursuing this FOIL request.
