Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
All emails possessed by Hostos Community College that meet the following conditions:
1. Sent to or from email addresses belonging to the office of Bronx borough president Ruben Diaz, Jr.
2. Sent from January 1, 2014 through the date when this request is processed, inclusive.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Skelding:
I write in response to your email request of September 29th which seeks: "All emails possessed by Hostos Community College that meet the following conditions: 1. Sent to or from email addresses belonging to the office of Bronx borough president Ruben Diaz, Jr. 2. Sent from January 1, 2014 through the date when this request is processed, inclusive." Your request is made pursuant to the New York State Freedom of Information Law (FOIL).
Since our receipt of your request, we have sent you two emails, the first acknowledging receipt of the request and the second referencing the large number of emails ostensibly matching this request. The second email also referenced the difficulty in retrieving archived material and indicated December 10, 2014 as the date when the College's response would be provided.
We have learned from the College's information technology department that the number of emails responsive to your request is over 2,000. New York courts and the Committee on Open Government of the New York Department of State interpret FOIL to require the requester to reasonably describe the records being sought, in part so as not to impose an undue burden on the respondent.
Accordingly, given the presenting facts and the standards applicable to FOIL requests, we are denying your FOIL request because it does not, in its current form, reasonably describe the records sought.
