Dear Records Access Officer,

Pursuant to the New York State Freedom of Information Law, Article 6 of the Public Officer’s Law, Section 84 et. seq., I am requesting copies of the following records, which I believe to be in the possession of your agency.

- Any emails sent by any individual associated with the Roffe Group P.C. on behalf of Apple Incorporated.
- Any responses from the agency in response to these emails.

I request that these records be released immediately, as required under the New York Freedom of Information Law, Article 6 of the Public Officer’s Law, Section 84 et. seq. I request that any records available in electronic format be reproduced in that format at my discretion, after conference with me. I ask that any information withheld be separated from releasable information, and that the releasable information be produced without delay, on a rolling basis, as it becomes available. I ask that the department justify the withholding of any information requested with specific reference to the section of law justifying such withholding.

Please consider this request in light of Linz v. The Police Department of the City of New York, which found, in part:

“The determination of whether a period is reasonable must be made on a case by case basis taking into account … the time involved in locating the material …” (Emphasis mine.)

As a journalist writing for a general audience, the release of these records is in the public interest, and as such I request that all copying fees be waived. If copying fees are expected to exceed $10, please contact me before duplicating any responsive records, so that I may select which records I may want reproduced.

If you have any questions, or if there is anything I can do to assist your office in fulfilling this request — including altering it to tailor the request for faster, less burdensome production after conference with me — please don’t hesitate to get in touch.
