Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
All emails and corresponding attachments sent to (to:, cc: or bcc:) or from Peter F. Vallone Jr. (or any person who communicates on his behalf) where the email contains any of the following keywords in the subject or body: "plastic bag", "ban on plastic", "hilex", "American Chemistry Council", "ACC", "bagtheban", "Progressive Bag Affiliates" or "PBA". Limit responsive emails to those sent between 06/20/2007 and 06/20/2008. If he does or did not use email, expand the search to all methods of communication which he does use.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please note that portions of the attached responsive documents have been redacted pursuant to §87(2) (b) of the Freedom of Information Law. Under §87(2)(b) agencies can withhold information where the release of the information would constitute an unwarranted invasion of personal privacy. Additionally, please be advised that portions of these records have been redacted pursuant to §87 (2)(g) of the Freedom of Information Law. Section 87 (2) (g) exempts from disclosure inter-agency or intra-agency records that are not (i) statistical or factual tabulations or data, (ii) instructions to the staff that affect the public , (iii) final agency policy or determinations, (iv) external audits, including but not limited to audits performed by the comptroller and the federal government. Examples of communications withheld are inter-agency or intra-agency communications that were expression of opinion, advice or non-final agency deliberations.
