Dear Mr. Hines:

Under the provisions of the New York Freedom of Information Law, Article 6 of the Public Officers Law, I hereby request a copy, in Adobe Acrobat or other electronic form, of all records or portions thereof pertaining to, or containing the following:

1. All records related or referring to the treatment of classification of UB School of Public Health employees as employees of the University at Buffalo Foundation, including, but not limited to, any communications referring to the status of School of Public Health employees, any reports commenced or completed regarding the status of School of Public Health Employees, and any determinations from the Internal Revenue Service or the New York State Charities Bureau regarding the status of School of Public Health Employees.

I understand that there is a fee of $0.25 per page for duplication of the records requested; however, the requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage. As such, and as releasing this information is in the public interest, I ask that you waive any duplication fees.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

As you know, the Freedom of Information Law requires that an agency respond to a request within five (5) business days of receipt of such request. Therefore, I would appreciate a response as soon as possible.
If for any reason any portion of my request is denied, please inform me of the reason or reasons for the denial in writing and provide the name and address of the person or body to whom an appeal should be directed.

We are unable to respond to your Freedom of Information Law (FOIL) request within twenty (20) business days from our last letter dated July 12, 2016 because of the volume of FOIL requests that I have received and the need to determine where documents may reside related to this FOIL request.

This is in response to your Freedom of Information Law (FOIL) request dated July 7, 2016 when you requested:
"1. All records related or referring to the treatment of classification of UB School of Public
Health employees as employees of the University at Buffalo Foundation, including, but not
limited to, any communications referring to the status of School of Public Health employees,
any reports commenced or completed regarding the status of School of Public Health
Employees, and any determinations from the Internal Revenue Service or the New York State
Charities Bureau regarding the status of School of Public Health Employees."

The Freedom of Information Law states in part that an applicant must "reasonably describe" the records sought as shown in ยง89(3) of the law. There is no date range for the documents requested. Further, your request for "any communications referring to the status of School of Public Health employees, any reports commenced or completed regarding the status of School of Public Health Employees," is not reasonably described. It is unclear what you mean by "status" of the employees. I have already done much work in regards to this request. It was after I completed the review process for this request that it became aware to me that I may have incorrectly inferred what you meant by "status". Please clarify what records you seek when you ask for "any communications referring to the status of School of Public Health employees, any reports commenced or completed regarding the status of School of Public Health Employees,". If it is possible for you to identify the records sought more specifically, I may be able to identify and locate them.

This is in response to your Freedom of Information Law (FOIL) request dated July 7, 2016 when you requested:

limited to, any communications referring to the status of School of Public Health employees,
any reports commenced or completed regarding the status of School of Public Health
Employees, and any determinations from the Internal Revenue Service or the New York State
Charities Bureau regarding the status of School of Public Health Employees."

In my last communication to you, dated October 5, 2016, I asked for further clarification regarding your request as you did not reasonably describe the records you seek regarding the "status" of Public Health employees. I have had no communication from you regarding this matter. Therefore I am not able to answer that portion of your request referring to the "status" of employees, thus I have no responsive records. You also ask for any "determinations from the Internal Revenue Service or the New York State Charities Bureau regarding the status of School of Public Health Employees." The University has no documents responsive to this portion of your request.

If you wish to appeal any part of this decision, you must do so in writing within thirty (30) days of your receipt of this email. The appeal must be directed to: FOIL Appeals Officer, Kellie Dupuis, Associate Counsel, Office of University Counsel, SUNY Plaza, Albany, New York 12246.
