Pursuant to the New York Freedom of Information Law, I hereby request the following records:

1.)Any and all reports, complaints, and narratives regarding the November 6, 2018 arrest of Tricia Vacanti.

2.)Any and all reports, complaints, and narratives between June 1, 2017 - August 31, 2018 for the following address: 620 Mountain View Drive, Lewiston, NY 14092

On November 6, 2018, on eight counts of endangering the welfare of a child and five counts of unlawfully dealing with a child Tricia Vacanti was arrested by State Police. Authorities “investigated a complaint of multiple occasions from June 2017 to August 2018 when Tricia Vacanti supplied alcohol for youths under 17 years old,” police said.

FOIL APPEAL - June 17, 2022
FOIL Number NYSP-22-06-1000

To whom it may concern:

I am appealing the withholding of additional records responsive to item 1 of my request "1.)Any and all reports, complaints, and narratives regarding the November 6, 2018 arrest of Tricia Vacanti." NYS Police stated they are exempt from disclosure by state statute, specifically Civil Rights Law § 50-b, as they identify the victim of a sex crime (see Public Officers Law § 87(2)(a)).

Rather than withhold the records in their entirety, the NYS Police should redact the names or any other identifying information the NYS Police feels necessary. NYS FOIL is based on transparency, not secrecy. Judging by previous redactions made on this FOIL request, the NYS Police does have the ability to redact. By withholding the records in their entirety, this violates the spirit and transparency of the NYS Freedom of Information Law. As such, please redact the aforementioned portions in the color black. I look forward to an early and favorable response. Please submit your response to the NYS Committee on Open Government. Thank you.
