Pursuant to the New York Freedom of Information Law, I hereby request the following records:
A complete and accurate count of all transgender inmates currently in custody in the Department of Corrections and Community Supervision as mandated to be recorded by the Prison Rape Elimination Act including:
-the number of transgender women in custody
-the number of transgender women who are housed in men's facilities
-the number of transgender men in custody
-the number of transgender men who are housed in women's facilities
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

There is no reasonable basis for the denial of this data as none of it provides identifying information on inmates. I have requested this information from every state in the country and Washington D.C. on behalf of NBC News. Nearly every state except for New York has provided these numbers. It is in the public interest to provide these numbers, which I will use to provide an accurate count of the number of transgender people incarcerated nationally. I kindly request that you reconsider so that I do not have to take legal action to obtain this information.
