To Whom It May Concern:

Pursuant to the New York Freedom of Information Law, I hereby request the following records:

1) Copies of all Predictive Model Reports provided to the university by EAB as part of its Student Success Collaborative product. These reports detail the predictive factors used to assign risk scores to students. A copy of an example report from another institution is attached for your reference.

2) All threshold reports provided to the university by EAB as part of its Student Success Collaborative product. A copy of an example report from another institution is attached for your reference.

3) Any differential impact analysis reports/studies compiled either by the university, EAB, or a third-party regarding EAB Student Success Collaborative's early warning system. These reports, sometimes called DIF or DIA studies, measure how the tools perform across different demographic or statistical groups.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Todd Feathers

This e-mail is in response to the records request you made to the Central Office of The City University of New York (“the Central Office” and “CUNY”) via e-mail pursuant to the New York Freedom of Information Law (“FOIL”). Specifically, you requested: 1) copies of all Predictive Model Reports provided to the University by EAB as part of its Student Success Collaborative product. These reports detail the predictive factors used to assign risk scores to students. A copy of an example report from another institution is attached for your reference; 2) all threshold reports provided to the university by EAB as part of its Student Success Collaborative product. A copy of an example report from another institution is attached for your reference; 3) any differential impact analysis reports/studies compiled either by the university, EAB, or a third-party regarding EAB Student Success Collaborative's early warning system. These reports, sometimes called DIF or DIA studies, measure how the tools perform across different demographic or statistical groups.
The Central Office has conducted a comprehensive search but has not located any records that would be responsive your request. I am advised that CUNY has not yet implemented the predictive model at its colleges.

If you disagree with any ruling made in connection with this request, you can appeal to the General Counsel and Sr. Vice Chancellor for Legal Affairs, Mr. Derek Davis, at the CUNY Central Office located at 205 East 42nd Street, New York, New York 10017.

Sincerely,
