This is responsive to your request under the Freedom of Information Law (“FOIL”) for copies of the following records,

“technical manuals about the operation of the OMNY fare payment system.”

In accordance with the procedures outlines in Public Officers Law (POL) §89(5), responsive records were denied pursuant to POL §87(2)(d), which states in relevant part that “an agency may deny access to records or portions thereof that:
(d) are trade secrets or are submitted to an agency by a commercial enterprise or derived from information obtained from a commercial enterprise and which if disclosed would cause substantial injury to the competitive position of the subject enterprise.”

In accordance with Title 21, New York Code of Rules and Regulations §1001.7, you are entitled to appeal this determination within thirty (30) days.
