Dear Ms. Nason:
This is in response to your Freedom of Information Law request for the following records:
- Copies of all information obtained by the New York State Division of Criminal Justice Services for the sexual assault evidence collection kit inventory report April 10, 2017 (http://www.criminaljustice.ny.gov/crimnet/ojsa/Sexual-Offense-Evidence-Kit-Report-4-10-17.pdf).
- Reporting requirements issued to law enforcement agencies and guidelines on collecting statistical data (From the report: "The law also designates the state Division of Criminal Justice Services (DCJS) as the agency responsible for educating law enforcement agencies about new reporting requirements and collecting statistical data required to be reported by those agencies and forensic laboratories")
Attached are the Sexual Offense Evidence Kit Inventory Report issued to the Legislature on March 1, 2017<http://www.criminaljustice.ny.gov/crimnet/ojsa/Sexual-Offense-Evidence-Kit-Inventory-Report-3-1-17.pdf> and the Sexual Offense Evidence Collection Kit Inventory Report -Update issued to the Legislature on April 10, 2017<http://www.criminaljustice.ny.gov/crimnet/ojsa/Sexual-Offense-Evidence-Kit-Report-4-10-17.pdf>. In Appendix B of each, you will find all correspondence to law enforcement agencies statewide which contain their applicable reporting requirements and guidance from the Division of Criminal Justice Services Commissioner and the Office of Public Safety.
Also attached is the final Survey export conducted on 4/12/2017 sourced from SurveyGizmo, our surveying solution, which reflects all electronic submissions made by law enforcement agencies statewide. The names and titles of the submitting officers and their direct email addresses and telephone numbers have been redacted from the survey on unwarranted invasion of personal privacy grounds pursuant to Public Officer Law §87(2)(b). The IP addresses have been redacted from the survey pursuant to Public Officers Law §87(2)(i) on the grounds that disclosure would jeopardize technology assets. It is noted that the data listed in the survey begins with number 17. Also the data in columns O,P,Q S and T of the Survey were auto-generated by SurveyGizmo. It is also noted that in those instances where there were multiple submissions by one agency, all of the agency's submissions are listed in the survey export attached above. The agency's most recent submission is reflected in the reports issued to the legislature.
Pursuant to Public Officers Law §89(4)(a), you may appeal this determination within thirty days to the Counsel, Division of Criminal Justice Services, 80 South Swan St., Albany, NY 12210 or by email at foil@dcjs.ny.gov<mailto:foil@dcjs.ny.gov> .

Valerie Friedlander
