Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

All records dating from April 2011 to present that pertain to notification by the University at Albany's University Police Department's Chief or his designee to the system administration office of university police regarding incidents involving the use of a firearm by a university police officer.

It seems necessary to note that the above is not a duplication of a request I've ever made to the University at Albany, that it is a specific and not overbroad request, and that it is, as the SUNY Police Manual indicates, the sort of information meant to be maintained at SUNY System Administration.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

SUNY Police Manual ยง 75.41: "After an incident involving the use of a firearm by a university police officer, the campus chief of university police will be notified as soon as possible by the officer involved in the incident. Each campus will have a formal notification procedure to the campus president and appropriate campus officials. In addition to campus notifications, the chief or designee will also notify the system administration office of university police as soon as possible."

"Use" is a term that is a fairly broad one, as the United States Supreme Court had decided in Bailey v. United States, 516 U.S. 137 (1996).
