Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
- Number of individuals authorized by the PM-ISE to access the New York State Intelligence Center's (NYSIC) intelligence databases who are not employed by the NYSIC or a contractor.
- Number and list of non-fusion center agencies authorized to access the NYSIC's intelligence databases.
- Number and list of source agencies who have submitted information NYSIC's intelligence databases.
- Number of times information posted to the NYSIC's intelligence databases had to be corrected or removed because it was erroneous or deficient, or because the source agency did not have authority to gather or share the information.
- Any documents relating to any instances where source agencies were determined to have used prohibited means to acquire information, or to have lacked the authority to acquire the original SAR information or submit it to the NYSIC's intelligence databases.
- Number and list of agencies who have violated the NYSIC's privacy policy.
- Records of all complaints received by the NYSIC and requests for corrections and the resulting action, if any.
- Breakdown of number of suspicious incident reports, suspicious activity reports, and field interview reports in the NYSIC's intelligence databases.
- Number and list of all public agencies and private contractors providing services of any kind to the NYSIC.
- Breakdown of the number of tips and leads in the NYSIC's intelligence databases acquired via intelligence information or email, phone, internet or incident report submission.
- Number of tips and leads in the NYSIC's intelligence databases acquired from cellphone tower dumps, cell site simulators (commonly known as "Stingrays"), and surveillance cameras.
- List of external agencies that access the NYSIC's intelligence databases or share information with the NYSIC.
- Number of persons within the NYSIC or in other governmental agencies who are authorized to have access to the NYSIC's intelligence databases.
- Number of complaints made to the Privacy Officer of the NYSIC.
- Number of times the NYSIC has notified individuals that their personal information was or is reasonably believed to have been breached or obtained by an unauthorized person.
- Number of times NYSIC personnel, a participating agency, or an authorized user have been found to be in noncompliance with NYSIC policy in regards to the gathering, collection, use, retention, destruction, sharing, classification, or disclosure of information.
- Number of times NYSIC personnel, a contractor, a participating agency, or an authorized user have been suspended, sanctioned, or otherwise disciplined.
- A copy of all contracts signed by the NYSIC.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
