We have found the attached record “UAS-Pepsi Pouring Rights 2017-2027” to be responsive to your request for “A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company”. The attached agreement has not been cancelled and is still in effect.

Dear Jordan:

I am following up on our email to you sent 8/22/2023 (a reminder was also sent on 9/13/2023) regarding your FOIL request hard copy letter dated June 29, 2023 for "records related to incidents of sexual misconduct over the past 5 years".

In response to:

1. Item # 1: "Incident Reports: All incident reports or complaints of sexual misconduct involving students, including those filed by the students themselves or others on their behalf" and
2. Item # 2: "Investigation Outcomes: Detailed records of any investigations undertaken in response to these reports, including the findings (such as sustained, not founded, inconclusive, etc.), any actions taken by the university, and the outcomes of any subsequent appeals":
As per the Public Officers Law Article 6, section 87.1, agencies are allowed to charge for the actual cost of reproducing records (beyond the first two hours, which are free). A quote to cover the actual cost (beyond the first two hours) of reproducing the responsive records was sent to you on 8/22/2023, giving you a deadline of 9/20/2023 to reply to us with an indication on whether or not you wanted to proceed with these parts of the request. We also sent a reminder on 9/13/2023. As we have not heard back from you, we are closing these parts of the request on the assumption that you are no longer interested in pursuing these records. You are welcome to resend a new request to the University at Albany campus at any time in the future, using the email Foil@albany.edu<mailto:Foil@albany.edu> .
3. Item # 3: " Litigation: Records of all litigation and court proceedings related to these incidents of sexual misconduct. This includes not only the cases initiated by the university or individual students but also any related court cases that support the premise that such information should be released under FOIA, such as case law establishing or affirming the public's right to access this type of information" : After a thorough check of our records, we have determined that the University at Albany does not have any record that would be responsive to this part of your request.
4. Item # 4: "Policy Changes: Any revisions or amendments made to the university's policies, guidelines, or procedures concerning sexual misconduct over the last five years in response to these incidents":

All responsive records were sent to you on 8/22/2023 (and also resent on 9/13/2023).
