Dear Ms. Merlan:

This is in response to your request under Freedom of Information Law (“FOIL”) for copies of, “Any security alerts issued to MTA/NYTC employees or signage displayed for MTA/NYTC [sic] workers from May 15, 2020 to whenever this request is processed, as well as any Security Incident Tracking System worksheets filled out by MTA employees between May 15, 2020 and the time this request is processed.”

Copies of responsive records are exempt from disclosure in accordance with NYS Public Officers Law § 87(2)(f), because “if disclosed could endanger the life and safety of any person,” and POL § 87(2)(i), that if disclosed, would jeopardize the capacity of an agency or an entity that has shared information with an agency to guarantee the security of its information technology assets." Therefore, your request is denied.

In accordance with Title 21, New York Code of Rules and Regulations §1001.7, you are entitled to appeal this determination within thirty (30) days. The appeal should be sent to: Chief Safety Officer Patrick Warren, Metropolitan Transportation Authority, 2 Broadway, 20th Floor, New York, New York 10004.
