Pursuant to the New York Freedom of Information Law, I hereby request the following records:

The master lease, all attachments and amendments thereof related to the sale of 40-50 Fountain Plaza, Buffalo, NY 14202 floors 3, 7, 8, 9, 10, 11 and 12 by Key Success c/o Ciminelli Real Estate Corp. to Fort Schuyler Management Corporation in 2015.

Please provide these documents in digital format in a timely manner. As you know, the New York Freedom of Information Law requires a response within five business days. Please provide the requested documents by or before November 8.

If you intend to take more than those five days to provide the records, please advise me in writing as to when you intend to do so. I wish to note the requirements stipulated in Section 89, 3a of FOIL:

If an agency determines to grant a request in whole or in part, and if circumstances prevent disclosure to the person requesting the record or records within twenty business days from the date of the acknowledgement of the receipt of the request, the agency shall state, in writing, both the reason for the inability to grant the request within twenty business days and a date certain within a reasonable period, depending on the circumstances, when the request will be granted in whole or in part.

If any portion of my request is denied, please state the statutory exemption and provide the name and address of the person or body to whom an appeal should be directed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
