Inventory, storage, receipt and distribution records for vaccines administered to students and/or employees at vaccine clinics which have taken place on school district property.
Please redact specific names and PII from these records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In response to your FOIL request noted below, the district hosted the
clinics, however it was the pharmacy that ran the clinic. The district has
no records responsive to this request.
If you are dissatisfied with this decision, you may appeal to the
District's Superintendent of Schools within 30 days. See Board Policy No.
1120-R.

I hereby appeal the denial of access regarding my request, which was made on March 28, 2022 and sent to:

The records that were denied include:
1. Inventory, storage, receipt and distribution records for vaccines administered to students and/or employees at vaccine clinics which have taken place on school district property.
As required by the Freedom of Information Law, the head or governing body of an agency, or whomever is designated to determine appeals, is required to respond within 10 business days of the receipt of an appeal. If the records are denied on appeal, please explain the reasons for the denial fully in writing as required by law.
In addition, please be advised that the Freedom of Information Law directs that all appeals and the determinations that follow be sent to the Committee on Open Government, Department of State, 41 State Street, Albany, New York 12231.

by independent pharmacies, and the district does not maintain any records
relating to the inventory, storage, receipt and distribution records for

On behalf of Jody Monroe, Superintendent, please see her response below.
I am in receipt of your appeal of the denial of access regarding your March
28, 2022 request, in which you sought records regarding the "inventory,
storage, receipt and distribution records for vaccines administered to
students and/or employees at vaccine clinics which have taken place on
school district property. Please redact specific names and PII from these
records."
As Ms. Curtis noted on March 28, 2022, and as Ms. Kehoe affirmed on
September 19, 2022, the clinics were run by independent pharmacies, and the
district does not maintain any records responsive to your request.
In response to your appeal of the denial of your request, I affirm the
denial, on the basis that any vaccination clinics on school property (*be
they for flu shots or for COVID*) are run by third-party clinicians and
there are no such records maintained by the district. Even if such records
were maintained, they would not be subject to release inasmuch as they
would be deniable records due to an unwarranted invasion of personal
privacy and also exempted from disclosure by state and federal statutes
regarding HIPAA and FERPA privacy laws.
Your appeal is therefore denied.
