Pursuant to the New York Freedom of Information Law, I hereby request the following records:

For School Year 2021-2022 (July 1, 2021 to June 30, 2022), who was the "Responsible Party" designated by your school district, as defined in pg. 1-2 of the New York State Department of Health's Interim Guidance For In-person Instruction at Pre-K through 12 Schools During the Covid-19 Public Health Emergency (Pre-K_to_Grade_12_Schools_MasterGuidance.pdf) (https://www.governor.ny.gov/sites/default/files/atoms/files/Pre-K_to_Grade_12_Schools_MasterGuidance.pdf, June 7, 2021), for:

• "...developing the plan, affirming to have read and adhere to this guidance, and meeting the standards set forth herein." pg 1
• for designated activities under the following headings outlined in the same document:
o Core Health and Safety Principles and Definitions
o Plan Requirements
o Monitoring
o Containment
o Closure

Please provide bonding and insurance information for all whom have been designated as the "Responsible Party" or one of several "Responsible Parties" for the above stated activities.

Please provide all plans, changes, amendments, and updates to the plans for reopening and operating during the COVID-19 public health emergency from July 1, 2021 to present, that were submitted to the New York State Department of Health (DOH) and the New York State Department of Education (NYSED) by your school district. Please include all affirmations to the Pre_K_to_Grade_12_Schools_MasterGuidance.pdf received in the district office and/or delivered to the New York State DOH or/and NYSED during the same time frame.

Please provide all correspondences regarding the plan TO and FROM the designated Responsible Party or Responsibility Parties to the New York State DOH, NYSED and the county or Local Health Department from July 1, 2021 to present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I hope this message finds you well. I am writing to follow up on my Freedom of Information Law (FOIL) request made on February 7, 2022, regarding the identification and communications of the Responsible Party in the North Colonie Central School District for the 2021-2022 school year.

I understand that compiling the requested information may require additional time, but I would like to kindly request an update on the progress made thus far. The last anticipated completion date provided was April 21, 2023, and I have yet to receive the requested documents.

As a reminder, my FOIL request includes the following:

Identification of the "Responsible Party" designated by the school district during the 2021-2022 school year.
Bonding and insurance information for the designated "Responsible Party" or parties.
All plans, changes, amendments, and updates submitted to the New York State Department of Health (DOH) and the New York State Department of Education (NYSED) from July 1, 2021, to present.
All affirmations received by the district office and/or delivered to the New York State DOH or NYSED during the same time frame.
All correspondences regarding the plan TO and FROM the designated Responsible Party or Responsibility Parties to the New York State DOH, NYSED, and the county or Local Health Department from July 1, 2021, to present.

I am writing to formally appeal the summary denial of my Freedom of Information Law (FOIL) request, submitted to the North Colonie Central School District on February 7, 2022.

Background:
My original request sought information regarding the identification and communications of the Responsible Party for the 2021-2022 school year, as detailed in my initial request. Despite multiple assurances of a response by specific dates, the North Colonie Central School District has repeatedly failed to provide the requested information or a valid reason for the delay.

Reason for Appeal:

1. Excessive Delays: The district has provided multiple anticipated completion dates, including March 11, 2022, April 21, 2023, June 30, 2023, and July 19, 2023. Each time, the district has failed to meet its own deadline without providing a satisfactory reason for the delay.
2. Lack of Transparency: The district’s repeated delays without clear justification hinder the public’s right to access information in a timely manner, as guaranteed by the FOIL.

Requested Action:
I kindly request that the North Colonie Central School District expedite the processing of my FOIL request and provide the requested information without further delay. If there are valid reasons for withholding any specific records, I request that the district provide a clear and specific explanation for each exemption applied, as required by law.

I understand the challenges that public entities may face in processing FOIL requests, but the repeated delays without clear justification are concerning. I trust that the district will uphold its obligations under the FOIL and provide the requested information promptly.
