I am specifically seeking records that would provide information on the timing and content of any changes or updates made to the meeting agendas during the periods in question.

If the district does not maintain logs or records specifically labeled as "audit logs" or "change logs," I request copies of any other records or logs that would provide the same information, such as system or database logs.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am writing to appeal the denial of my Freedom of Information Law (FOIL) request, which I submitted on April 10, 2023, seeking records of logs or records that provide timestamps of documents and information posted to BoardDocs meeting agendas for a list of specific dates, as well as any changes or updates made to the meeting agendas during those periods.

On April 17, 2023, I received a response from Paula Tibbitts, School Legal Practice Specialist at Capital Region BOCES, stating that there were no records responsive to my request.

I believe that the denial of my request is in error, as the requested information should be maintained according to the LGS-01 document retention schedule for information technology and data. Specifically, the LGS-01 schedule outlines retention requirements for various types of records, including:

"System or Database Logs": These logs should be retained for the period of time specified in the record-keeping requirements for the related system, database, or application. In this case, the related system or database would be the one that stores BoardDocs meeting agendas.

"Audit Trail Records": These records are required to be maintained for a minimum of six years after the completion of the audit or the resolution of the audit findings, whichever is later.

Given the above retention requirements outlined in the LGS-01 schedule, I respectfully request that you reconsider your search for the requested records and provide any logs or records that pertain to BoardDocs meeting agendas and any changes or updates made to the meeting agendas during the specified periods.

In the event that my request is denied again, I kindly request a written explanation for the denial, specifying which exemption(s) to the FOIL are being applied, as well as any other reasons for the denial.
