I am writing to appeal the summary denial of access regarding my New York Freedom of Information Law (FOIL) request made on August 5, 2022. The request sought a log of, or records reflecting, all Freedom of Information Law requests submitted to the North Colonie Central School District since January 1, 2016 or as far back as such records are kept.

It has come to my attention that my original request was acknowledged on November 18, 2022, followed by a communication from the district on December 20, 2022, indicating that additional time was needed to fulfill the request. However, since then, I have not received any formal response or updates regarding the status of my request.

The New York Freedom of Information Law requires that agencies respond promptly and within a reasonable period. Given the substantial delay and lack of communication, it is clear that the district has not fulfilled its obligations under the law. I appeal this denial of access and request that you provide a formal response addressing my original request.

I would appreciate a timely and substantive response that includes an explanation for the denial, if applicable. Additionally, please inform me of the district's obligations under the law regarding the retention of records during the appeals process.

Thank you for your attention to this matter. I look forward to a prompt resolution and the release of the requested records.

The request sought a log of, or records reflecting, all Freedom of Information Law requests submitted to the district since January 1, 2016, or as far back as such records are kept.

Under FOIL (Public Officers Law §89(3)(a)), an agency is required to grant or deny access to records within five business days of receipt of a request. If the agency cannot provide the requested records within that time, it must provide a reason for the delay and a date by which the records will be available, which cannot exceed twenty additional business days.

In this case, the district has repeatedly extended the deadline for fulfilling my request, most recently to July 14, 2023, which significantly exceeds the statutory time limit. This delay constitutes a constructive denial of my request, and I am appealing this denial.

I kindly request that you review this matter and provide a timely response to my original request. I look forward to your prompt attention to this matter.
