Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

- A log of all requests for agency records under the Freedom of Information Law received since January 1, 2015 or as far back as such records are kept.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

HESC is not yet able to have a response ready to your FOIL request dated October 2, 2017, a copy of which request is attached below.

In preparing a response for you, certain redactions have been necessary, as authorized by FOIL, relating to the names and personal records of individuals mentioned in the FOIL log whose personal information is protected by federal and/or New York State law. Due to the size of the response HESC is preparing for you, researching and confirming the identities of each of the specific individuals involved has taken longer than I originally anticipated in my initial acknowledgement of receipt of your FOIL request.

Pursuant to FOIL §89(3)(a), this is to inform you that the date certain by which HESC will have a response ready for you is Friday, November 24, 2017.

As I previously informed you, when HESC’s response is ready it will be provided for you as a scanned attachment to another email from me and will be provided for you at no charge.

Thanks John I appreciate the diligence. If this is helpful to know: In the interest of expediency and perhaps conserving your sanity, with respect to this specific request (FOIL log) only, to the extent information in responsive records contains potentially sensitive information relating to students, please feel free to err on the side of redacting those details rather than going through a more rigorous, drawn-out process to assess the applicability of exemptions to each name etc., even if doing so might yield a more-redacted final product.

Again, I appreciate the diligence—and perhaps procedures are procedures—but in this particular instance I do not anticipate objecting/appealing to redactions of names and other potentially sensitive information. I am more interested in the “big picture” of the kinds of records people are requesting.
