Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Emails sent or received by Lawrence G. Reuter, (President, New York City Transit, 2007-2009) in which the subject line contains any of the following non-case sensitive terms: “swipers”, “swiper”, “selling swipes” or “mattocks” during the 2008 calendar year (1/1/2008-12/31/2008).

My request should not be construed to include duplicate copies of any material.

Please advise me of the appropriate time during normal business hours for inspecting these records prior to obtaining copies.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

My apologies for the delay, but pertaining to the subject of the FOIL request, which sought all emails sent by or received by Lawrence G. Reuter, (President, New York City Transit, 2007-2009), in which the subject line contains any of the following non-case sensitive terms: “swipers”, “swiper”, “selling swipes” or “mattocks” during the 2008 calendar year (1/1/2008-12/31/2008). Please be advised that we conducted a thorough search for anything containing the “terms” identified above, and were unable to obtain any responsive records. Dear Records Access Officer,

I seek clarification on your official response to my request for emails sent to or from the former NYCT President Lawrence G. Reuter during a two-year period.

A letter from your office on 3/1/2019 indicated it was "working diligently" to review records. Yet a keyword search in which no responsive documents are discovered should take a matter of minutes - approximately as long as it would take to author a letter giving your office an extension - but the response took ten months to arrive. Further, it is not credible that a person in Mr. Reuter's position received or made no electronic communication over a matter routinely reported in the the press and squarely under his purview during that time period.

I hereby request a second search for these terms in Mr. Reuter's email records. If somehow my request had been construed to include only incidents in which these terms appeared in quotation marks in their original context, I hereby request a search for these same terms without those quotation marks.
