Dear Mr. Ponte:
This email is in response to the above-referenced FOIL request.
Please be advised that the Freedom of Information Law, Public Officers Law, § 89(3) requires a requestor to reasonably describe the records requested.  A requestor meets that responsibility when an agency can identify and locate records based on the terms of the request.  In short, whether a FOIL request reasonably describes the records sought depends not just on the terms of the request but also on the nature of an agency’s filing, indexing, or record-retrieval mechanism.
Based on the information you have provided, the Office of the Attorney General (“OAG”) cannot conduct a diligent search for the records you seek, because our records are not coded or maintained by the particulars of your request.  Despite the fact that it is specific, your request is not consistent with the Department’s record-keeping system.
Accordingly, your request does not reasonably describe records of this Office.
Further, please be advised that, while the OAG will neither confirm nor deny the existence of an investigation related to the “phrases” you reference in your request, if the documents you have requested do exist, they would be exempt from disclosure and withheld pursuant to: • Public Officers Law § 87(2)(a), which provides that records that are exempted from disclosure by state or federal statute are exempt from disclosure under FOIL.  The records would constitute attorney work product, which is exempt from disclosure under Civil Practice Law and Rules § 3101(c); • New York Public Officers Law § 87(2)(e), because the records would constitute documents compiled for law-enforcement purposes that would, if disclosed, interfere with law-enforcement investigations or judicial proceedings; and • Public Officers Law § 87(2)(g), because the records would constitute inter-agency or intra-agency materials.
