I am writing to formally appeal the implicit denial of my Freedom of Information Law (FOIL) request, which was submitted to the North Colonie Central School District on 6/1/22.
Background:My original request sought all communications involving Jennifer Bennett and other parties within the North Colonie Central School District. The request was comprehensive and aimed to obtain various forms of communication for the purpose of public interest.
Timeline of Correspondence:
• 6/1/22 : FOIL request submitted.
• 7/7/22: The date by which a response was legally required.
• 8/30/23: As of today, I have not received any records or any communication regarding the status of my request, other than sporadic extension requests outside the statutory timeframes permitted by law which seem to be a flagrant and overt obstruction of FOIL.
Basis for Appeal:The prolonged delay without a substantive response or valid reason constitutes an implicit denial of access to the requested records, which is in violation of the Freedom of Information Law.
Action Requested:I kindly request that the North Colonie Central School District:
1. Acknowledge this appeal in writing within the stipulated timeframe.
2. Conduct a diligent search for the requested records.
3. Provide the requested records without further delay or provide a valid legal basis for withholding them.
I appreciate your prompt attention to this matter. Please understand the importance of transparency and the public’s right to access records under the Freedom of Information Law.
