From: Brad Aaron

To Whom It May Concern:

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

I request a copy of all records pertaining to a traffic collision that occurred on July 22, 2017, in the borough of Brooklyn, at or near the intersection of Franklin Street and Noble Street, that resulted in the death of Neftaly Ramirez, including the possible causes of the collision, the persons involved in the collision, and the damage caused by the collision.

I further request a copy of all records, including emails sent to and from the @brooklynda.org domain, containing information on which the Brooklyn District Attorney's Office based its decision to file criminal charges, or its decision to file no charges, in connection with this collision. And all records, including emails sent to and from the @brooklynda.org domain, that contain or reference that conclusion or that discuss potential criminal actions or charges in connection with the collision.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Brad Aaron

Dear Mr. Aaron:

This email acknowledges receipt of your request for records pursuant to the Freedom of Information Law (FOIL). Please be advised that a search for the file[s] that may contain the records you have requested has been commenced. Once that search is completed, we will be able to determine whether this office possesses such records, and, if so, whether you are entitled to receive them under the provisions of the Freedom of Information Law.

However, as you no doubt can imagine, this office receives a tremendous volume of FOIL requests each month. Accordingly, to be fair to all applicants, FOIL requests are generally answered in the order in which they are received. Since there are presently other outstanding requests that were received by this office before your own, fulfillment of your request must wait until these others are answered.

Therefore, in accordance with Public Officers Law §89 (3), you are hereby advised that you should receive a response to your request on or about April 13, 2018.

Sincerely,
