1033 program application (SUNY Old Westbury)

To Whom It May Concern:

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The applications submitted to the Defense Logistics Agency, Disposition Services by SUNY's Old Westbury's campus police for enrollment in the 1033 program.

That SUNY's Old Westbury's campus PD is enrolled in the program has been published online here: http://www.capitalnewyork.com/article/albany/2014/10/8554535/report-suny-branches-armed-through-pentagon-program

Records requested include the application for M16A1 rifles, the utility truck, and any equipment that SUNY Old Westbury's campus PD applied for but was denied.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Kimmins,

Thank you for quickly responding to this request.

However, I did not request information or comment on the equipment obtained by SUNY Old Westbury through the program. I requested the applications submitted by SUNY Morrisville to the DLA, DS for equipment that it was and was not supplied with.

Your response does not satisfy my FOIL request: you did not advise me of whether SUNY Old Westbury possesses applications responsive to the request or not, and whether such applications are releasable.

Are you able to provide those applications, or is this response a final disposition? If it is final, I will appeal it.

Thank you for talking on the phone yesterday.

You mentioned that you have the application in front of you, but need to consult with your legal team. Do you anticipate when you'll know whether you can release it?

I would note that the police departments of SUNY Oneonta and SUNY Morrisville, the other two SUNY PDs that received equipment through the 1033 program, released their applications to me.
