Hi there

Record request #21-6094 has been closed. The closure reason supplied was:

We cannot fulfill your request because it is unreasonably burdensome and expensive in light of the City's limited resources and the vast amount of data involved. See La. Rev. Stat. § 44:33A(2). You have requested three (3) years’ worth of annual leave of approximately 1,400 New Orleans Police Department’s Officers. In order to accomplish this, the custodian of records would have to manually pull each of the paper leave forms for three (3) years for 1,400 officers, which would equate to at least 1 million pages.

Equally, the database containing leave information cannot be filtered to provide only annual leave. In order to fulfill your request using the database, each data record for each of the 1,400 officers will have to be reviewed and redacted to exclude non-public information (e.g., social security numbers, retirement benefits, etc.).

Segregating the requested records would be time consuming and tedious, and would further prohibit the concurrent completion of any other civic duties and responsibilities. "It is well established that the examination of records or requests for reproduction cannot be so burdensome as to interfere with the operation of the custodian’s constitutional and legal duties." Beckett v. Serpas, 2012-1349 (La. App. 4 Cir. 3/20/13), 112 So. 3d 348, 353 (citing Vandeweghe v. Parish of Jefferson, 11-52 (La. App. 5 Cir. 5/24/11), 70 So. 3d 51 & Elliott v. District Attorney, 94-1804 (La. App. 1 Cir 9/14/95), 664 So.2d 122).

Thus, your request will not be fulfilled. If there is a particular officer for which you would like to request this information for a shorter period of time, please make a new request.

Our office has responded to your request and considers this request closed.

Please provide leave data from the aforementioned database for the dated jan 1 2021 to jan 3 2021. If it is in a database redactions should be easy, programmatic and not overly burdensome.
