Pursuant to the Louisiana Public Records Law, I hereby request the following records:

-Currently valid policies/procedures relating to public housing and Section 8 housing assistance eligibility for applicants on the basis of arrest/conviction record
-Currently valid eviction policies/procedures for tenants in public housing and Section 8 housing units
-Currently valid policies/procedures regarding obtaining criminal conviction records from law enforcement agencies and sex offender registration information from the appropriate state/local agency responsible for the maintenance of sex offender registration program
-Any reports compiling the data of applicants to public housing and Section 8 housing assistance from January 1, 2017 to December 31, 2017
-Any reports compiling the data of public housing and Section 8 housing assistance denials and the basis of those denials between January 1, 2017 and December 31, 2017
-Any logs of police reports related to activity in public housing and Section 8-subsidized units between January 1, 2017 and December 31, 2017
-Any grievances/complaints of discrimination submitted between January 1, 2017 and December 31, 2017 including any of the following words/phrases:
-crime
-crimes
-criminal
-convict
-convicted
-sex offense
-sex offender
-jail
-prison
-correctional facility
-probation
-parole
-conviction record
-arrest record

Please provide materials on a rolling basis, as they become available.

Your Public Records Request was received and forwarded to the appropriate department(s) for the collection of the requested documents. Please note that the Housing Authority of New Orleans (HANO) can only provide you with public records where HANO is the custodian.

You will be notified when the public records are available for you to inspect and/or have copies provided.

Listed below are the fees for copying records. All payments for copies of records must be made, via check or money order, payable to the Housing Authority of New Orleans.

*Paper: Copies @ $0.25 per page.
*Electronic: Base fee of $25 for records copied onto a compact disc.
*Delivery: Additional delivery/postage fees may apply depending on form and/or bulk of delivery.
*Additional Fees: Additional service fees may apply depending on the scope of the request.

The Louisiana Constitution, Article XII, Sec. 3, provides that "no person shall be denied the right to observe the deliberations of public bodies and examine public documents, except in cases established by law." The courts and the legislature of Louisiana have clearly established that the right of access to public records is not unlimited.

The Louisiana Public Records Law can be found at La. R.S. 44:1, et seq.

The legislative exceptions to the Public Records Law can be found at La. R.S. 44:4.1.
When requesting access to public records from the Housing Authority of New Orleans (HANO), you must clearly specify whether you want to inspect the records, copy the records, reproduce the records, or obtain from the Custodian a reproduction of the records. The Custodian may collect a fee for making copies of public records (La. R.S. 44:32(C)(1)(a)).

HANO will make all reasonable effort to timely respond to requests for access to public records in accordance with the provisions of the Public Records Law. Notice will be provided in all instances where the public nature of the records is in question.

I am writing in response to the attached follow-up letter of October 24, 2018.

As was noted in the October 22, 2018 email that was sent by HANO to the requests@muckrock.com<mailto:requests@muckrock.com> electronic mail address that was provided and designated as the preferred method of communication, HANO is currently collecting any documents in its offices that are responsive to your request. A copy of the October 22, 2018 email that was sent by HANO to requests@muckrock.com<mailto:requests@muckrock.com> is also attached.

At this timey, HANO is working within its Asset Management, Executive, HCVP, IT, Legal, and Police Departments to collect any electronic or hard-copy documents that are responsive to your request. Predicting the time frame in which you can expect to receive any documents that are responsive and have been located with any degree of certainty is difficult. However, given the fact that HANO's search is using both electronic and by-hand searches, our best guess, and it is only a guess, is that it may take several days or even several weeks to complete the search.
