Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

All contracts (and their amendments), memorandums of understanding, intergovernmental service agreements, and any agreements of any sort entered into by the New Mexico Department of Corrections for all services, equipment, and activities involving/provided by/contracted for regarding Guadalupe County Correctional Facility and any facilities associated with it through any of the aforementioned agreements regarding the facility.

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments
• all invoices/receipts detailing compensation received as a result of any agreements
• all agreements related to the provision of services, such as water and sewage
• all financial agreements (such as loans or bonds) entered into as a result or in association with any of the aforementioned agreements
• all agreements regarding the utilization of inmate labor by any agency within this entity's jurisdiction

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Department has a contract with Guadalupe County to house inmates, and the County in turn has a contract with GEO to operate the county correctional facility. There was no RFP process because agreements with the county or other governmental entities are exempt from the procurement code, as are agreements between counties and private prison operators or vendors such as GEO. The Department will have a copy of its contract with Guadalupe county and any amendments, but not copies of the agreement between the county and GEO to operate the facility. It will take more than three days to gather the contract documents within the Department’s custody, and will likely take fifteen days (until April 21, 2016).

The Department will not have any responsive documents regarding water, sewage, loans, or bonds because of the arrangement described above. Guadalupe County or GEO may have those responsive documents, if any, and should have a copy of the contract between the county and GEO. Also, I am not sure what you mean or want when you request all inmate labor agreements by any agency within this entity’s jurisdiction. What entity’s jurisdiction? Please clarify this request.
