To Whom It May Concern:

Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Sincerely,

Evan Anderson

Hi there,

Thank you for the response. Does this mean the Human Services Department is not in charge of Medicaid? When I search Medicaid in New Mexico on Google the only agency that comes up is the Human Services Department. Is there another agency I should send this to? Or is the Human Services Department in charge of Medicaid but does not have possession of these records?

Thanks,
Evan

From: NM Human Services Department

The Department does oversee the State's Medicaid program, however, the information you requested is not in an exisiting report. Under the Inspection of Public Records Act, the State is not required to create a document in response to a request. The Department would have to run an ad hoc report and there would be a fee associated with this request.

Hi again,

I understand that agencies are not required to create a document. However, most agencies do not interpret querying a database as creating a new report, since the information already exists. For example, I have submitted an identical request as this one to all 50 states and none so far has argued that this would be creating a new report, even though I've gotten that response many times in the past for different records requests.

I'd appreciate it if you could provide a cost estimate for the following: A spreadsheet of Medicaid claims for treatment of Dissociative Identity Disorder (ICD-9 300.14, ICD-10 F44.81), for date of service from 1/1/2000 through 2017. The data elements I am specifically seeking are the following: date or year of service, provider (or NPI), cost, and service provided (e.g. psychotherapy).

Thank you,
Evan

This is a follow up to a previous request:

Thank you,
Evan

The Department does oversee the State's Medicaid program, however, the information you requested is not in an exisiting report. Under the Inspection of Public Records Act, the State is not required to create a document in response to a request. The Department would have to run an ad hoc report and there would be a fee associated with this request.

Thanks,
Evan
